Securing Modifications or Terminations of Existing Orders
Orders for child support, child custody, visitation, alimony and spousal support may not be set in stone. Courts are generally to consider a family's circumstances when issuing these types of orders. When those circumstances change, a modification of the order may also be necessary. To modify an existing child support order, parenting plan, or award of alimony, you may be required to demonstrate that there has been a change in circumstances significant enough to justify the request for modification. In some circumstances, you may be required to demonstrate that the substantial change in circumstances is permanent in nature and is not voluntary to obtain relief from a court order. Enforcement or Contempt for Failure to Comply with Existing Orders If either party fails to comply with the terms and conditions of a court order involving child support, time-sharing, child custody, a parenting plan, or alimony, the other party can bring an enforcement action in court. Contempt of a court order may be issued by a court when a party fails to pay child support or alimony, fails to properly deal with marital debts or assets, or fails to ensure that the other parent receives all the parenting time they need. Orders of contempt and enforcement can be severe and may involve immediate payment of support, incarceration, corrective fines and garnishments and other harsh methods to ensure compliance with a court order.
